[https://novasean.com/legal] Legal and trust documents Legal and trust Consumer rights and withdrawal Consumer protections depend on the real purpose and circumstances of the contract.Customer information This page explains its stated scope. Existing agreements and mandatory legal rights continue to apply. On this page • Who this information is for • Withdrawal from a distance service contract • Model withdrawal form • Online withdrawal function • Digital-service quality and redress Who this information is for The new service offer is directed at business-purpose customers. This does not remove rights from anyone who legally qualifies as a consumer. Existing customers keep the protections applicable to their agreements. A business label or checkbox alone does not decide the position of a person acting outside their trade or profession. Before a consumer distance contract is concluded, the provider must supply the required service, identity, contact, total price including taxes, term, renewal, cancellation, complaint and withdrawal information, and relevant digital-service functionality and compatibility information. The consumer must have a clear opportunity to review and correct the order and expressly recognise any payment obligation. Confirmation and the required information must be provided on a durable medium. Withdrawal from a distance service contract Where the statutory right applies, you normally have 14 days from concluding the service contract to withdraw without giving a reason. Send a clear statement before the period ends to support@novasean.com or the address in [https://novasean.com/legal/provider-information] Provider information. You may use the form below, but it is not compulsory. Missing required withdrawal information can extend the period under the law. If you expressly requested service performance during the withdrawal period after receiving the required information, a proportionate charge for service supplied before withdrawal may be due. The right is lost for a fully performed service only where the legal conditions, including prior express consent and acknowledgement, are met. A continuing hosting service is not automatically fully performed at activation. The separate digital-content exception must not be assumed to apply to every hosting service. Where reimbursement is due, it must be made without undue delay and no later than 14 days after notice of withdrawal, normally by the same payment method unless otherwise expressly agreed and without a reimbursement fee. This information does not limit a more favourable contractual right. Model withdrawal form Complete and send this only if you wish to withdraw from a contract: To: Maarten Strootman, trading as NovaSEAN through Straeder, Karekietstraat 18, 1431 WP Aalsmeer, the Netherlands; support@novasean.com. I/We hereby give notice that I/We withdraw from my/our contract for the supply of the following service: [identify service]. Ordered on: [date]. Name of consumer(s): [name]. Address of consumer(s): [address]. Signature of consumer(s), only if this form is notified on paper: [signature]. Date: [date]. Delete as appropriate. You can save or print this page and send the completed text by email or post. Online withdrawal function For a covered consumer distance contract concluded through an online interface, the law also requires an easily accessible online withdrawal function during the withdrawal period, a confirmation step and prompt confirmation on a durable medium. This information page and email option are not that function. No completed online withdrawal function is represented here. The relevant consumer order journey must provide it before it is used for a covered sale. Digital-service quality and redress Where consumer digital-service rules apply, the service must meet the contract and applicable objective conformity requirements, including required updates. Statutory remedies can include bringing the service into conformity and, where the conditions are met, price reduction or termination. A general disclaimer or a service credit cannot remove those protections. See [https://novasean.com/legal/complaints] complaints and redress; mandatory applicable law and protected court jurisdiction remain available.
